Terms of Service

These are the rules for using RFPHawk. In plain English: don\u2019t abuse the service, pay for what you use, and we\u2019ll do our best to keep things running. The formal version follows below.

Agreement

These Terms of Service ("Terms") are a contract between you and RFPHawk ("we," "us," or "our"). By creating an account or using RFPHawk (the "Service"), you agree to these Terms. If you don\u2019t agree, don\u2019t use the Service.

If you\u2019re using RFPHawk on behalf of a company, you represent that you have the authority to bind that company, and "you" in these Terms refers to both you personally and your company.

Your account

You need an account to use most of RFPHawk. When you sign up, you agree to:

  • Provide accurate, current information (name, email, company).
  • Keep your password confidential and not share your account.
  • Notify us promptly if you suspect unauthorized access to your account.
  • Be at least 18 years old (or the age of majority in your jurisdiction).

You\u2019re responsible for everything that happens under your account. One account per person or per business. Automated or programmatic account creation is not allowed.

Acceptable use

You may not, and may not allow anyone else to:

  • Scrape, crawl, or bulk-extract data from the Service by any means other than our public API (when available) or features we provide (like export).
  • Resell, sublicense, or make the Service available to third parties as a service of your own.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to send spam, harass others, or distribute malware.
  • Bypass rate limits, security measures, or the free-tier limits that apply to your account.
  • Impersonate another person, business, or entity.
  • Use the Service for any illegal purpose, or in violation of any applicable law or regulation.
  • Interfere with or disrupt the integrity or performance of the Service or the data it contains.

We reserve the right to investigate and suspend or terminate accounts that violate these rules.

Subscription & billing

Plans

RFPHawk offers a free tier with limited features and a Pro tier at $20/month. The specific features included in each tier are described on our pricing page, which is incorporated into these Terms by reference.

Billing cycle

Pro subscriptions are billed monthly in advance. Your first charge occurs when you upgrade, and subsequent charges occur on the same day of each month. If a month doesn\u2019t contain that day (e.g., the 31st in February), we\u2019ll charge you on the last day of that month.

Auto-renewal

Pro subscriptions renew automatically each month until you cancel. You authorize us to charge your payment method on file for each renewal. You can cancel anytime from Settings \u2192 Billing.

Payment processing

All payments are processed by Stripe. We don\u2019t store your full card number. Stripe\u2019s terms and privacy policy also apply to your payment transactions.

Price changes

We may change prices at any time, but we\u2019ll notify existing subscribers by email at least 30 days before a price change takes effect. If you don\u2019t want to pay the new price, you can cancel before the next billing cycle.

Taxes

Prices are exclusive of applicable sales tax, VAT, or other taxes, which will be added where required by law.

Cancellation & refunds

You can cancel your Pro subscription at any time from Settings \u2192 Billing, or by emailing billing@rfphawk.com. Cancellation takes effect at the end of your current billing period \u2014 you\u2019ll keep Pro access until then.

We don\u2019t offer pro-rated refunds for partial months. However, if you believe we\u2019ve charged you in error, email billing@rfphawk.com within 30 days and we\u2019ll make it right.

Deleting your account (Settings \u2192 Danger Zone) automatically cancels any active Pro subscription and permanently removes your data within 30 days.

Your content

"Your Content" means anything you upload or enter into RFPHawk: your company description, NAICS selections, saved RFPs, notes, pipeline stages, and similar. You own Your Content. We don\u2019t claim any ownership over it.

You grant us a limited, non-exclusive license to store, display, and process Your Content solely for the purpose of operating the Service for you. This license ends when you delete Your Content or your account.

You\u2019re responsible for ensuring Your Content doesn\u2019t violate any laws or the rights of others.

Our content & data

The RFPHawk platform \u2014 including our code, design, brand, and the organized database of RFP opportunities we aggregate \u2014 is our property. You may not copy, redistribute, or build a competing service using our platform or data.

Individual RFP records themselves are public-record data sourced from government procurement systems (SAM.gov, state portals, etc.). Those public records remain freely available at their original sources. Our value is in the aggregation, matching, alerting, and user experience \u2014 and that\u2019s what these Terms protect.

Match scores, categorizations, and other derived data we generate are provided for your internal use and may not be resold.

Service availability

We aim to keep RFPHawk available 24/7, but we don\u2019t guarantee uptime. The Service may be unavailable for scheduled maintenance, unscheduled outages, or reasons outside our control (provider outages, natural disasters, etc.).

We\u2019ll post known issues at rfphawk.com/status when available. For extended outages affecting Pro subscribers, we may issue service credits at our discretion \u2014 email support@rfphawk.com to request one.

We make no guarantee about the completeness, accuracy, or timeliness of the RFP data. Always verify details at the original source before submitting a proposal.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA.

RFPHawk is a discovery and matching tool. We do not guarantee that you will win any contract, that the opportunities we surface are the right fit for your business, or that the information displayed is complete or current. You are responsible for your own due diligence and proposal decisions.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RFPHAWK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST CONTRACTS, OR LOSS OF DATA, ARISING OUT OF YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.

Some jurisdictions don\u2019t allow the exclusion of certain warranties or limitations on liability, so parts of this section may not apply to you.

Termination

You can terminate this agreement anytime by deleting your account.

We can terminate or suspend your account at any time if you violate these Terms, engage in fraudulent or illegal activity, or if required by law. For material violations we\u2019ll try to give you notice and an opportunity to fix the issue first, except in cases involving abuse, security, or legal requirements.

On termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (ownership, disclaimers, liability, governing law) will survive.

Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. Any legal dispute arising out of these Terms must be brought in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

If you\u2019re a consumer in the EU, UK, or another jurisdiction with mandatory consumer-protection rules, nothing in these Terms overrides your mandatory statutory rights.

Changes to these terms

We may update these Terms from time to time. For material changes, we\u2019ll notify you by email at least 14 days before the change takes effect. For minor changes (fixing a typo, clarifying language that doesn\u2019t change your rights), we may post the updated version without individual notice.

Continued use of the Service after an update means you accept the revised Terms. If you don\u2019t accept, please stop using the Service and cancel your account.
